No delay in exercising any right or remedy or failure to object will be a waiver of such right or remedy or any other right or remedy. A waiver on one occasion will not be a waiver of any right or remedy on any future occasion.
5.2 We will not be liable for indirect, special or consequential or like loss or damage or any loss of revenue, profits or data arising in connection with this Agreement and/or the Affiliate program and/or any termination thereof, even if we have been advised of the possibility of such damages. Further our aggregate liability arising with respect to this Agreement and/or the Affiliate program and/or the termination thereof will not exceed the total commission paid or due and payable under this Agreement for the 12 month period immediately preceding the event giving rise to the payment obligation.

If it comes to our attention that you are spamming, we will consider that cause for immediate termination of this Agreement and your participation in the Merchant.com Affiliate Program. Any pending balances owed to you will not be paid if your account is terminated due to such unacceptable advertising or solicitation.
Some Amazon affiliate site builders will continue with business-as-usual, but others are looking to at least diversify their businesses, if not move away from Amazon entirely. While you can still sell these assets for a very nice exit, it’s probably worth at least revisiting the fact that having all of your earnings on another platform opens you up to risk when/if they decide to make changes.
3.2. Merchant.com reserves the right to terminate this Agreement and your participation in the Merchant.com Affiliate Program immediately and without notice to you should you commit fraud in your use of the Merchant.com Affiliate Program or should you abuse this program in any way. If such fraud or abuse is detected, Merchant.com shall not be liable to you for any commissions for such fraudulent sales.
One major disadvantage for an affiliate is the lack of control she has over the offer made to the customer, the sales page and the amount of commission earned. Super affiliates, those with a proven record of driving high-converting traffic, can negotiate preferential terms, but this option isn't open to the new affiliate. It is not unknown for merchants to cancel an offer without informing their affiliates, or to pay commissions late or not at all.
