Applicable Law. This Agreement shall be governed by the laws of the Commonwealth of Massachusetts, without regard to the conflict of laws provisions thereof. In the event either of us initiates an action in connection with this Agreement or any other dispute between the parties, the exclusive venue and jurisdiction of such action shall be in the state and federal courts in Boston, Massachusetts.

Thanks for the write-up on EasyAnon. I was debating whether or not to give it a try. I’ve been using Amazon Product In A Post (free plugin) since November. It is ok, but sometimes some of the links don’t show up, plus I would like the ability to customize the photos/links a bit more. I feel like if you have 98% only affiliate content and no other valuable content it’s more likely to be penalized. I was following a lot of competitor sites in Ahrefs and noticed all the ones that tanked had only thin affiliate content and no non-affiliate content. For some reason I thought FixYourSkin was yours but I was wrong. That site went down like crazy and lost their traffic by half. I saw them trying to recover by adding more quality content but it doesn’t seem to help for them and it’s not helping me either.

Many affiliate marketers start out with amazon.com through their affiliate program called Amazon Associates. Their commission structure is very low and can range from 4% to 10% only but you can also leverage their global selection of products and amazon’s popularity. You could also think of the places you have shopping from online and I am almost certain they will have some sort of affiliate programs that you can join for free.


There is another opportunity out there for the savvy Amazon FBA owner, or even e-commerce store owner, as this Amazon update rolls out industry wide. That advantage is the ability to strategically acquire Amazon affiliate sites that are related to your niche. When you do this, you are basically buying traffic at a discount since these Amazon sites will dip in their earnings, and thus value, while still keeping the same amount of traffic.
You get to hand-pick what you promote. Unlike display ad systems that typically choose which brands serve ads on your WordPress site, you have total control over this with Amazon affiliate links. You’ll never have to worry about a competitor’s link showing up on your site and the link will always be relevant to the content that it appears within or beside--which will improve its chances of getting clicked.
So I went to the same place I buy all my WordPress themes (Themeforest) and searched their hundreds of demo WordPress Themes to find the right one that made sense for my Amazon Affiliate Website. Hey Chris, ok I have an affiliate site with 2000 products. Is their a plugin or something to let me know if a product is no longer available. Or is their a plugin that checks links everyday automatically to let me know if their is a problem. Nothing worse than clicking a link to find out the page is no longer available. If you are going to write a piece of content that has an affiliate link to a high-end DSLR camera, you need to be an expert in order to make it credible. Your whole website needs to revolve around the product and how to use it, rather than eyeing up the fat commission you can make if you dupe someone into using your link from that one piece of content.
For example, say you get 1,000 visitors to your site each day. If your conversion rate is 1 percent, then that means 10 of those visitors will end up purchasing something you recommended. You will market Local Associates Products to Amazon customers only at those locations and through those methods by which you customarily conduct your registered business. Solely with respect to the Local Associates Program, and notwithstanding anything to the contrary in the Participation Requirements, you may include Special Links in written physical and digital materials (including email) which are displayed, distributed, emailed, or offered to customers, clients, or third parties with whom you have a preexisting relationship; provided, that such written physical and digital materials are in compliance with the Associates Program Operating Agreement, the Trademark Guidelines, and the Amazon Brand Usage Guidelines. Upon our request, you will provide us with representative sample materials and written certification that you have complied with the foregoing. Their policies are strict. Be sure to read through Amazon’s affiliate program policies very carefully. Any violation of their policies is grounds for account suspension--something which could be devastating if you build an entire website or store around affiliate links. Amazon has also been known to suspend accounts without any prior notice, so tread carefully.
11.8. Obligation to Mediate in Good Faith. Except as provided in this Section 11.7, before either party initiates a lawsuit against the other relating to this Agreement, the parties agree to mediate all disputes and claims arising out of or relating to this Agreement, the parties' performance under it, or its breach. To this end, either party may request, after informal discussions have failed to resolve a dispute or claim, that each party designate an officer or other management employee with authority to bind the party to meet in good faith and attempt to resolve the dispute or claim through mediation. During their discussions, each party will honor the other's reasonable requests for information that is not privileged and relates to the dispute or claim. This Section does not apply (i) should the expiration of the statute of limitations for a cause of action be imminent, or (ii) if a party is seeking an injunction pursuant to Section 11.8.
You will ensure that the information in your Associates Program application and information otherwise associated with your account on the Associates Site, including your email address, other contact information, and identification of your Site, is at all times complete, accurate, and up-to-date. We may send notifications (if any), approvals (if any), and other communications relating to the Associates Program and the Agreement to the email address then-currently associated with your Program account. You will be deemed to have received all notifications, approvals, and other communications sent to that email address, even if the email address associated with your account is no longer current.

What initially attracted me to using Amazon’s Affiliate program was the breadth of products that they had in their system. This is a great thing if you’re niche is narrow or quite obscure as many bloggers find it difficult to find affiliate programs to match their blog’s focus. Blogs like John’s and mine here at ProBlogger do have an array of options for affiliate programs (which is why I don’t use it a lot on this blog and make most of my earnings from Amazon from product related blogs) but many bloggers don’t have the luxury of being able to choose high paying affiliate programs because they simply don’t relate to our topics. Amazon then becomes one of the more attractive options.

MA shall protect copyrights, tradenames, trademarks, service marks, trade secrets and other confidential proprietary rights and information of Company and its affiliates and report promptly any infringements or suspected infringements of which MA becomes aware and to cooperate fully with Company in its efforts to protect its copyrights, tradenames, trademarks, service marks, trade secrets and other confidential proprietary rights and information.
Other than the limited licenses expressly set forth herein, we reserve all right, title and interest (including all intellectual property and proprietary rights) in and to, and you do not, by virtue of this License or otherwise, acquire any ownership interest or rights in or to, the Associates Program, Special Links, link formats, Program Content, PA API, Data Feeds, Product Advertising Content, any domain name owned or operated by us, information and materials on any Amazon Site or the Associates Site, our and our affiliates’ trademarks and logos (including the Amazon Marks), and any other intellectual property and technology that we provide or use in connection with the Associates Program (including any application program interfaces, software development kits, libraries, sample code, and related materials).

Business Practices. Company shall not specify the business practices of MA, nor regulate the manner in which MA shall operate its business, provided that MA (a) conducts business in a manner that reflects favorably at all times on the Technology sold and the good name, goodwill and reputation of Company and its affiliates; (b) avoid deceptive, misleading or unethical practices that are or might be detrimental to Company and/or its Affiliates, the Technology or the public, including but not limited to disparagement of Company or the Technology; (c) make no false or misleading representation with respect to Company or the Technology; and (d) make no representations with respect to Company or the Technology that are inconsistent with any applicable license agreement(s) for the Technology provided by Company, promotional materials and other literature distributed by Company pertaining specifically to the Technology, including all liability limitations and disclaimers contained in such materials.
Networks are the best source for determining the going commission rate among competitors. Before joining a network, most merchants or program managers sign up with a couple of the larger ones as an affiliate. This gives them access to the network’s database, and they can do a search for the starting commissions being paid out by other businesses in their industry to get a feel for how much they can charge.
(j) You will not exceed, or if you build and release an application that calls PA API, each copy of that application that is installed by an end user will not exceed, any limit on calls per second set forth in any Specifications (or that we otherwise notify you apply) and you will not send files to or from PA API that are greater than 40KB without our prior written approval.
Are they biting the hand that feeds them? Possibly. We will have to wait and see. Maybe Amazon gave the higher commission %’s to the products that have the highest markup…? i.e. their Amazon coins. I do believe tho they have reduced the incentive their own “affiliate employees” previously had to push their products-and maybe, just maybe this new commission structure will not last long.
Requests for direct comment from Gawker Media surrounding their use of and investment into affiliate marketing went unanswered. But investing into custom platforms and granular data collection doesn’t seem like something a publisher the size of Gawker Media would be doing unless it were a central part of their current and future overall monetization strategy.
