It is the intent of FatCow to treat all of our customers fairly. Accordingly, we require all FatCow Affiliates to comply with applicable laws, regulations and guidelines concerning advertising and marketing, including without limitation, the Federal Trade Commission (FTC) Endorsement Guides, which require that material connections between advertisers and endorsers be disclosed. This means that all Affiliate Sites (e.g. directories, review/rating websites, blogs, and other websites) and any email or collateral that provide an endorsement or assessment of FatCow’s Products and Services must prominently disclose the fact that you receive compensation for Referred Customers.
Meeting the standard can be complicated enough if you are running direct linking campaigns as an affiliate. It becomes even more complex if you are building an email list or running another complex funnel that requires you to collect personal information. Make sure you have a simple way of collecting data reports and deletion requests so you can respond in a timely manner.
15.1. You agree that you are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Merchant.com. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on Your Site or any other of Your Site or otherwise, that reasonably would contradict anything in this Section.
For example, say you get 1,000 visitors to your site each day. If your conversion rate is 1 percent, then that means 10 of those visitors will end up purchasing something you recommended. If the average commission you receive is $5, then that means each day you'll earn 10 * $5 = $50 on average. This gives you an idea of what you can do to improve your affiliate business. To grow from this point, you can either work to increase the number of readers you have or you can work at increasing your conversion rate.
Shortly thereafter, Mr. Abdulloev joined the affiliate marketing forum on a site called ABestWeb. In addition to serving as a kind of industry police blotter on the latest frauds, the forum is a good way for merchants to stay abreast of important developments, like the shifting local sales tax landscape. (Thirteen states have laws that require merchants working with affiliates in those states to charge sales tax, but the issue is constantly being litigated.)
b) All legal or other fees incurred in collecting returned checks or declined credit cards or any other lack of payment related to a sale made by an affiliate will be payable by the affiliate. Any sums not collected from the affiliate or affiliate’s customer are not commissionable, and any fees incurred during processing or handling of sales made by the affiliate will be deducted in whole from any commissions due to the affiliate. Further, in the event that the commissions due the affiliate are insufficient to cover any sums, the affiliate agrees to pay the full amount to the Program Operator.
You are the sole and exclusive owner of the Affiliate Trademarks and have the power to grant to FatCow the license to use such marks in the manner contemplated herein, and such grant will not (i) breach, conflict with, or constitute a default under any agreement or other instrument applicable to you or binding upon your assets or properties, or (ii) infringe upon any trademark, trade name, service mark, copyright, or other proprietary right of any third person or entity.
